1) What’s the difference between a Pre-Nup and a Marriage Agreement?
a. They are the same, however, Marriage Agreements are more commonly known as pre-nups, or pre-nuptial agreements.
2) Why are they important?
a. They help spouses have important discussions before getting married.
b. They help manage expectations during a marriage.
c. They save money on litigation costs upon separation or divorce.
3) What documentation do I need?
a. Parties to a pre-nup, pre-nuptial agreement or marriage agreement should exchange all financial information in order for the agreement to be valid and enforceable after a divorce.
4) Why are pre-nups so expensive?
a. You are paying the lawyer an hourly rate to review financial information, draft or review the agreement, provide you with an opinion as to entitlement, legality, validity and enforceability, negotiating and finalizing the agreement.
b. The cost of your pre-nup, pre-nuptial agreement or marriage agreement depends on how big your portfolio is, and the amount of time it takes the parties to negotiate the terms.
