In family law, a marriage agreement is also known as a pre-nup, they are an agreement for spouses entering into a marriage. Cohabitation agreements are agreements for spouses who wish to live together but do not intend to marry. These written agreements are legally binding between two parties in a marriage or common-law partnership.

Agreements can be entered into at any time, but it is best to do so as soon as possible after your relationship begins. Having a written agreement will support your decision-making about assets and property, and if you separate, it will help ensure there is less conflict when dividing those assets if you decide to separate.
